NURSING HOME ASSET PROTECTION IN A NUTSHELL

(Married Couples with One Ill Spouse)

  1. The house and all assets should be conveyed to the HEALTHY SPOUSE.
  2. The HEALTHY SPOUSE should adjust their estate plan so that if unexpectedly die first:
  1. The ill spouse will be bypassed pursuant to state law.
  2. Most of the assets will pass to the children and will not be exposed to the nursing home.
